Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the boatofthe.day mobile application ("App") or submitting content via our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of London, Ontario.

3. Use of the App

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

Restrictions: You may not:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Resell, redistribute, or sub-license the wallpapers provided within the App (e.g., you cannot take "today's boat" and sell it on a stock photo site).
• Use the App to harass, abuse, or harm another person.

4. User-Submitted Content (The "Boat Photos")

We may allow users to submit photographs of boats ("User Content") for potential feature in the App. By submitting User Content, you agree to the following:

• Ownership: You retain all ownership rights to your User Content. You are not transferring your copyright to us.
• License Grant: By submitting User Content, you grant boatofthe.day a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content in connection with the App and our marketing materials.

In plain English: You still own your photo, but you are giving us permission to use it in the app forever, for free, and we don't owe you money for it.

• Attribution: We will make reasonable efforts to credit you (using the name you provide) if your User Content is selected, but we are not strictly liable for accidental omissions.

Warranties: You represent and warrant that:

• You own the User Content or have the necessary licenses/rights to submit it.
• The User Content does not infringe on the copyright, trademark, or privacy rights of any third party.
• The User Content does not contain offensive, illegal, or inappropriate material.

Right to Reject: We reserve the right to reject or remove any User Content at our sole discretion, for any reason, without notice.

5. Purchases and Subscriptions

• Google Play: All purchases (including one-time purchases or subscriptions) are processed through the Google Play Store. You are subject to Google Play's Terms of Service regarding payments, billing, and refunds.
• Refunds: We do not process refunds directly. Refund requests must be made through Google Play.

6. Intellectual Property

The App itself (including its design, code, and "boatofthe.day" branding) is the property of the developer. The wallpapers provided are either owned by us, licensed to us, or used with permission.

7. Copyright Infringement

We respect the intellectual property rights of others. If you believe that content on our App infringes your copyright, please contact us at legal@boatofthe.day with details of the alleged infringement. We will respond to valid notices in accordance with applicable law (including Canadian copyright law).

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not guarantee that a specific boat class or type will be featured on any given day.

9. Limitation of Liability

To the fullest extent permitted by law, boatofthe.day shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of the App.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this document. Your continued use of the App after any such change constitutes your acceptance of the new Terms.
